Markal Travel shall not be liable for failure of travel service suppliers, including but not limited to airlines, hotels, steamship lines, railroads, car rental agencies, tour operators and consolidators to perform the services offered by such suppliers. Markal Travel, and its affiliates, successors, agents, and employees strongly advises you/travelers to purchase covered trip insurance, and in providing travel management services, does not guarantee or insure the services to be provided by any supplier, the financial position of such suppliers or the reimbursement to you from any loss experienced as a result of the financial condition of such supplier. In the event that a supplier defaults prior to providing the service to you for which payment has been made, the sole recourse for refund shall be with the defaulting supplier, from insurance covering such defaults if any or from other responsible third party unless such was caused by Markal Travel.

In those situations in which a supplier defaults prior to providing services you may pursue any recourse against the supplier for refund, which may be permitted by law or statute in the state of Minnesota. Markal Travel warrants that it provides the highest standards of quality services in the trade and will use appropriate care in selecting suppliers so as to protect and/or limit your investment from such default.

Except as expressly stated herein, Markal Travel assumes no responsibility for actions relating to travel services beyond the control of Markal Travel or its employees. Markal Travel is not responsible or liable for any act, error, omission, injury, airlines policies and tariff, government regulations, loss, accident, damage, delay, nonperformance, irregularity, or any consequence thereof, resulting from airlines policies and tariff, which may be occasioned through neglect, or default or any other act or inaction of any supplier of Travel products. Markal Travel shall not be liable for any fluctuation in price(s) or change in schedule or equipment or accommodations for any travel service, which occurs subsequent to payment for such service, and any such fluctuation shall solely be the responsibility of the purchaser of travel services through Markal Travel.

Markal Travel acts as a service bureau that provides value added service to individual travelers, corporate and/or retail travel agents. Markal Travel has no control over and assumes no liability for the actions of the suppliers from whom it obtains Travel products. For your convenience Markal Travel has included its service bureau fee, “Mark-up” in the fare quoted to you. Our service bureau fee may vary depending on a number of factors, including the market conditions, the amount of savings we pass on to you, the time and effort we spend on locating the tickets you request at the best prices, upgrades applied if any, your form of payment, etc. Our service bureau fee is non refundable in the case(s) of cancellations for any reason, no show, failure to board, missed flights, loss of ticket not caused by Markal Travel and/or its employees. Any omissions, and or errors in naming convention due to the fault of the traveler is not our responsibility, also, including but not limited to surcharges for services reissue(s) are strictly the liability of the purchaser of our services and may be in addition to increases in the cost of such services at the current rate.

Once tickets have been issued there shall be a penalty involved for refunds, exchanges, reissues, and cancellations for future use. We do not have control over printed prices on the tickets, although most tickets may have BT (Bulk fare) printed on them, some may have a specific value on them, which may be different (lower or higher) than the fare collected, these differences where applicable, may be due to our bureau fees and charges. For retail travel agents and/or independent contractors, we urge you to inform your client of this policy.

Discounts offered may vary depending on a number of factors including Airlines utilized, class of service, destination, time of year (Low, mid or High Season), advance notice provided, minimum stay requirements fulfilled and flight load. In order to obtain the most cost effective priced services for your benefit, we may combine more than one, two or three airlines, and may bundle such, to provide you the cheapest cost for the services requested. In the event of such bundling any exchanges, reissue, cancellations, failure to board, etc, the fees charged may be highly prohibitive in following the terms and conditions of each individual supplier(s) combined to obtain the cheapest service costs for you.

LIMITAIONS OF LIABILITY

Under no circumstances, including, but not limited to, negligence, shall we, and/or our providers or distributors, be liable for any damages to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing on the site, or your downloading of any materials, data, text, images, video, audio, or other information from the site. In no event shall we, and/or our providers or distributors, be liable for any injury, loss, claim, damage, or any special, punitive, indirect, incidental, or consequential damages of any kind (including, but not limited to, lost profits or lost savings), whether based in contract, tort, strict liability, or otherwise, that arise out of or are in any way connected with the use, or the inability to use, the site or the services or materials on the site, even if advised of the possibility of such damages. In no event shall our aggregate liability, or that of our providers or distributors, exceed the total charges set forth in the itinerary giving rise to any such liability. Any claim or cause of action arising from, or relating to, your access and use of, or purchase of products and/or services from, the site must be brought within one (1) year from the date on which such claim or action arose or accrued or purchase was completed. Applicable law may not allow the limitation or exclusion of liability of incidental or consequential damages, so the above limitation or exclusion may not apply to you. Your use of the site shall be at your own risk. We are acting as an intermediary or as an agent for providers of travel-related products and/or services by promoting, selling or accepting reservations or bookings for such products and/or services (such as air and ground transportation, hotel accommodations, meals, tours, cruises, travel insurance, etc.).

INDEMNIFICATION

All Users agree to protect and indemnify Markal Travel, its affiliates, and/or their respective suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by:

  • you or on your behalf in excess of the liability described above; or
  • by third parties as a result of
    • your breach of our Terms, Conditions and Notices or the documents referenced herein;
    • your violation of any law or the rights of a third party; or
    • your use of this our services, directly and/or through our Web site.

WEBSITE USAGE AND TICKET PURCHASE

You warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement and to use this Web site in accordance with all terms and conditions herein. You agree to be financially responsible for all of your use of this Web site (as well as for use of your account by others, including, without limitation, minors living with you). You agree to supervise all usage of this Web site by minors under your name or account. You also warrant that all information supplied by you or members of your household in using this Web site is true and accurate. Further you also confirm that the traveler is not an unaccompanied minor. Without limitation, any exploratory, false, or fraudulent reservation or any reservation in anticipation of demand is prohibited. You agree that the travel services reservations facilities of this Web site shall be used only to make legitimate reservations or purchases for you or for another person for whom you are legally authorized to act. You understand that overuse or abuse of the travel services reservation facilities of this Web site may result in you being denied access to such facilities.

All offers, prices, and conditions of sale may be subject to:

  • change without notice
  • advance purchase, eligibility, seating, or other limitations
  • travel days, dates, minimum or maximum stays, holidays, seasons, blackout dates, stopovers, and/or wait-listing restrictions
  • reservation validation limitations of up to one year (if any extension permitted, penalties/restrictions may apply); and/or
  • other conditions/restrictions
  • availability. Lower prices may be available. If your itinerary involves an ultimate destination or stop in a country other than the country of departure, the provisions of a treaty known as the "Warsaw Convention" may be applicable to your entire trip, including any portion entirely within the country of origin or destination. The Warsaw Convention governs and may limit the liability of certain air carriers for death of or personal injury to passengers and/or loss of or damage to baggage.

A reservation is not complete until confirmed/ticketed. To protect our customers, we verify with the credit/debit card company that the billing address and credit card verification number you provided to us is accurate and that your debit/charge will be accepted. Until such information is verified, the fare is subject to change. Certain airlines and/or suppliers may refuse to accept credit cards payment for certain destinations and services, and in such event, we reserve the right to surcharge you for a minimum of 4% of the total cost of your purchase through the use of our merchant account to complete and obtain your desired product(s) and services. We are not responsible for any transaction that is declined based upon a credit/debit card that is declined by the issuing company or a travel provider or if, for any reason, the debit/credit card billing address and/or credit card verification number cannot be verified in a timely manner, nor are we responsible for any changes in fare or any other charges that may occur during our verification process. At times when the Fare selected is not available an approval code may have been taken on your credit card, if the transaction is not completed the approval code may block your available credit for a time period until the bank removes the block.

REFUNDS

All our tickets, hotels and fees are NON-REFUNDABLE, at times if you have applied for refund with us, we do not guarantee the time period it may take for the refunds to be processed. All refund requests are on REQUEST basis only, please contact us after 72 hours to re-confirm if the refund or void request has been processed. Please allow another 60 days to reflect on your credit card after the re-confirmation that the refund request has been approved.

CREDIT CARD DECLINES

At the time of processing your transaction if your credit card declines, we will make all efforts to notify you by way of an email and/or telephone message within 3 business days. The transaction will not be processed if your credit card has declined. The FARE is NOT GUARANTEED and may change in the process of attempting to obtain payment.

CHANGES

Any changes made to the itinerary is restricted, all our tickets/hotels/cars/packages/cruises do not allow any date or name changes after the booking is completed. We advise that you purchase insurance. Markal Travel does not guarantee, and shall not be responsible for, any bookings or reservations made or confirmed by agent to the customer in the event that the original itinerary has been changed pursuant to customer's request.

DISCOUNT OF AIRFARES

In accordance with the US Airline Deregulation Act, Open Sky Agreements, and subsequent codifications, discounting on air tickets is now legal. Due to our large volume, and numerous purchasing sources, we are allowed to bring you many published air fare prices for less than the carriers’ published price. Please note that Service fees are charged above the discounted air fares to provide value to our customers such as 24/7 toll free # call center support, ticketing, quality control, technology automation, etc.. The value of discount may vary based on fare type, availability, seasonality, referral source and destinations.

FEES

In order to serve you better and for costs of automation, customer service, quality control, airline reporting, GDS scan costs, Fulfillment, Dispatch, and other rated services, we charge a percentage fee on all Domestic issued airlines tickets, hotel reservations, train-Amtrak services, etc, and a Mark-up for all our international issued airlines tickets hotel reservations, train - Amtrak services etc. For the convenience of our repeat customers, we may at times, guarantee a specified air fare upon a requested reservation in agreement of both parties and upon a payment of an advance deposit equal, or more than those established in the airlines’ fare rules in accordance with its tariff. If you cancel the reservation  before final payment, but due to no fault of ours, we shall retain the exact equivalent of the cancellation fees as provided in the specific airlines’ fare rules for which your reservation was based. Any advance deposit in excess of such specified cancellation fees, shall be refunded to you within a reasonable time frame, or as soon as time permits. At all other times, only service fees are always NON - REFUNDABLE. Original service fee charged at the time of bookings is non-refundable for any reason(s). Cancellation fee charged at the time of cancellation of reservation is non-refundable for any reason.

OUR PROCESSING SERVICE FEES

This assures a quality product as we strive to provide you with the finest level of service and pricing.

FARE CHANGES

At times even after the confirmation of a reservation, but before payment is actually made and received by us, the fare may change, we will notify you of any fare changes and we do not assume any responsibility - financial or otherwise for any such fare changes. We will notify you of the new fare and at that point you may either cancel or still purchase the product at the new cost.

TICKET DELIVERY

If an e-ticket could not be issued for a particular reservation or if a delivery was being made of another product or service, Markal Travel will send the paper ticket, product or service through a secure mode of delivery (a reputed courier company) and the applicable shipping charges debited to the credit card holder's account as per pre-existing rates of the courier supplier. Markal Travel does not assume any responsibility for the fault of the delivery company. We will attempt to redeliver but do not provide any guarantees for redelivery on time. If you provide incorrect address, then you may have to pay excess fees to the delivery company for alteration of the address. You will be billed to the credit card used for payment. If an e-Ticket is generated the ticket information will be available on the web-site.

 

CREDIT CARD PAYMENTS TERMS

  • All credit cards must have verifiable US or Canadian billing address.
  • If you are using Third party credit card, please contact us at support@markaltravel.com with your requirements.
  • If there is any issue with the Credit card, we will notify you within 24Hrs, by submitting the Credit Card; it automatically does not guarantee "Ticketing".
  • Markal Travel bears no responsibility in the event your Credit card is not charged, and you agree to reimburse Markal Travel for the full payment thereafter. There can be number of reasons for which credit card may not have been charged by Markal Travel, such as Airline has not confirmed the booking, Fare has increased since payment information is submitted, Insufficient funds available in the credit card etc.
  • You are agreeing to reimburse the bureau fees and/or mark-up to Markal Travel if the client/traveler disputes the credit card payments.
  •  Markal Travel uses stringent safety measures for credit card payment processing. Fraudulent transactions if any, are reported to Airport Security, Airlines and other Federal and State organizations
  • You agree to be liable for any and all credit card payments disputes or other problems such as Fraud made to us or the supplier on behalf of your client. You agree to reimburse Markal Travel in cases of Fraud or Charge backs.
  • All credit card transactions over phone to our Customer Service Department may be tape  recorded and are available as evidence in case of any dispute or for legal form of evidence.
  • Credit card transactions are authorized by user’s accepting terms and conditions or electronic signature, and by providing to us your specific personal information such as the identifying three digit Code on the back of Visa/M-card, or Four digit Code for American express cards, billing address, telephone number(s), e-mail, and the exact name of the card holder.
  • Issued airline tickets on credit cards are the property of the card holder, are fully non refundable subject to and in accordance with the airlines’ fare rules, and may be used within one-year from the date of issue upon satisfaction of the fare rules upon which the ticket was issued. The fare difference rule may apply.

 

TERMINATION

We reserve the right, in our sole discretion, and without liability, to terminate your access to all or part of our services directly and/or on this website, with or without notice, for any reason or no reason.

SCANS

If you abuse the system with numerous scans and not enough Ticketed bookings, we will terminate your agreement immediately.

 

Baggage Policy On Connecting Flights - When there are 2 airlines involved for connecting flights then you may have to re-claim your bags at Connecting Airport and check in again for onward journey at your own risk. You are also advised that in such cases, your baggage, and/or excess baggage may be subject to charges twice, by each airline. Additionally, the airlines reserve the right to surcharge one or more of your allowed free-check-in baggage at any time without notice.

 

Credit Card Authorization Forms - At times for HIGH RISK transactions such as one way International tickets, Foreign origination tickets, we may need a Credit Card Authorization form to be filled out by the card holder, we do NOT guarantee that the fares may be valid until we receive the credit card authorization form filled out. Our failure to obtain from you, such credit card authorization does not invalidate, nor constitute a waiver of our right to reimbursement of the amount of purchase once your reservation is issued and/or ticketed. At times the tickets may be issued even if we have not received the form back. All issued tickets are NON REFUNDABLE and are subjected to the sole terms and conditions of the airlines’ fare rules applicable to such tickets.

 

AIRLINES SCHEDULE CHANGES

We encourage you to re-confirm your flight schedules with the airlines 72 hours prior to departure. Failing which we advise you to reconfirm your flight schedules at least 24 hours prior to your departure. These days many airlines make schedule changes due to reasons only known to them.

Please note we shall make our best efforts to notify you of any such schedule changes. However it is not a guarantee that we shall be always able to make successful contact with you through phone or e mail to deliver to you such important travel update. We do not own any liability for cancelled flights, flights that are missed or flights mis-connection due to any scheduled changes.

 

GENERAL RESTRICTIONS

All flights should be re-confirmed with the airline directly as they may have last minute schedule changes. . We recommend that you do so at least 24 hours prior to departure for domestic flights (72 hours for flights to Hawaii and international destinations)

In most cases, upgrades standbys will not be permitted.

Many of our discounted tickets do not allow for Frequent Flyer Mileage Accrual.

Seat assignments will be made at the airport on the day of departure or by contacting the airline directly.

Tickets will not be sold to unaccompanied minors age 18 and under. Tickets may be purchased for minors age 18 and under; however, they must be accompanied by an adult when traveling.

We reserve the right to cancel requests for High Security Risk Areas.

All customers are advised to know the entry requirements for the country(ies) to which they are traveling or entering. Reliable information regarding international travel can be found at www.travel.state.gov.

Markal Travel's sale of tickets to you does not imply any guarantee of passenger's ability to enter the country of destination. Traveler understands that Markal Travel accepts no responsibility for determining passenger‘s eligibility to enter any specific country.

A passenger’s duty or departure tax may be assessed upon departure from some international destinations such as Mexico, and the United Kingdom and Australia. This is the passengers responsibly and is not collected by Markal Travel upon purchase.

A $25.00 administrative fee will be charged for travel receipts requested after departure.

 

HUMAN ERROR OR CUSTOMER SERVICE AGENT’S ERROR

If any of our agent makes a mistake or any human error is made we shall make every attempt to rectify any such errors. Markal Travel stands committed to provide compensation up to a maximum of entire service fees only that Markal Travel has collected in addition to a $ 10.00 USD free coupon as redemption towards purchases from Markal Travel in the future.

 

 

ITINERARY RE-CONFIRMATION

It is the responsibility of the passenger who has booked with us directly and/or online or has made booking over phone to review and reconfirm names, dates, flight numbers, airlines, routing including any airport changes are in accordance and acceptance of the passenger. If you discover any discrepancy or you don’t agree, you are requested to immediately contact Markal Travel over phone not over 4 hours from the time booking is made.

If we don’t hear from you within 4 hours we shall consider the booking you have made is acceptable to you and we don’t hold any liability thereafter for any changes whatsoever.

You are requested to review and save the Itinerary with you.

 

AUTHORITY TO SEND COMMUNICATION

By approving this transaction you are authorizing Markal Travel to send you communication in the form of email, postal mail, instant messaging, phone call, text messaging and any other form of electronic or paper communication. This communication will be primarily for customer service and may include special offers from time to time.
